How Mark Bunker can get his Youtube account back.

I've examined Mark's situation in quite a bit of depth in a three part video. The short analysis is that it isn't nearly as hopeless a situation as it appears. Mark can make a good faith argument that his use of the Colbert clips fell within Fair Use.

Viacom issued 100,000 DMCAs in February 2007. Nearly 60 of them were TOTALLY bogus. They targeted videos that didn't use any Viacom material whatsoever. Many others were somewhat bogus in that they targeted videos that made Fair Use of Viacom clips. The Electronic Frontier Foundation sued Viacom over their DMCA dragnet. The resulting understanding provides an opportunity that Mark can exploit to get his account back.
