Australian C&D Letters

I too have received a copy of the letter the same as the AnonSA admin (see this thread: http://forums.enturbulation.org/98-f...ember-o-12727/) and I was wondering what recourse and action we have against these wild accusations. Obviously they have no evidence to prove something that didn't happen, and them pursuing anything in these letters would be a major footbullet.

Also, there's two cases, me and SA where this letter has been recieved -- is there anyone else in Australia who has received a similar letter?

The letters seem targeted at those who are in charge of the websites of the Anonymous groups across Australia -- their thinking must be that these are the hubs where the "leaders" of Anonymous spread their supposed lies and misinformation.

Silly footbullet by scientology - simply proving the point that fair game still exists. Report the letter to the police - it can open the door to involving scientology in legal issues. :)

If I were you, I would also be calling my hosting, and complaining to them for giving out your information (I presume you have private WHOIS, which you pay for?).

I understand those letters are quite suitable for framing. They're being handed out like candy all over the world.

As well as getting in touch with the police, might be worth looking on what the rules are for Aussie lawyers? If that letter can be viewed as harassing/defamatory, you could look to make a complaint about the conduct of the lawyers. And - if they did get your details through your whois info - I think it may be a problem for them if they did so based on inaccurate claims.

No, you have been hoodwinked by a totalitarian cult. The accusations are baseless, and probably the threats were manufactured by Scientology itself, as ethical protesters do not indulge in bomb threats, death threats, and sending wheat germ by mail.

Where are the police reports generated by these threats? For a cult that freely squalls to the police every time there's a peaceful protest, you'd think bomb threats would result in a flurry of complaints. And yet...there are none.

Why?

Because the cult is doing it to themselves, a kind of abusive masturbatory practice meant to portray them as victims.

So basically, the letter directs you to quit doing the stuff you haven't been doing all along. Easily complied with. Keep not sending bomb threats, death threats and wheat germ. (btw, who the hell has wheat germ in their cupboards? Besides health food nuts and Scientologists, that is...)

The Law Council of Australia’s Model Rules of Professional Conduct has this to say about communications with third parties:

28.1 A practitioner must not, in any communication with another person on behalf of a client: …

28.1.2 make any statement that is calculated to mislead or intimidate the
other person …

This standard is reflected in laws governing legal professional conduct across Australia.

Do you lot in Oz have an equivalent to the Data Protection laws in Europe, which entitle you to find out what information an organisation has on you and check that it is being held and used legally?

If they are keeping your details legally, it doesn't do much except use up their time and resources answering you. If they aren't complying with law, however.....!!
